Similitudes et différences entre l'arbitre commercial et le juge national
Abstract
Puisque l´arbitrage est le mode naturel de reglement des litigse dans le commerce international, il obtien la reconnaissance de tout les pays et les organisations internationals. Il est le mode conventional juridictionnel par lequel les arbitres rendent une sentence ayant la chose jugee. Il n´y pas de bon arbitrage sans bon arbiter. C´est pourquoi, il faut confier a l´arbiter les memes pouvoirs accordes aux juges nationaux, car il rend une sentence juste et motifiees a´l instare des jugements nationaux, et cela après la deliberation execute par les arbitres selon le principe de collegialite. A partir de la, il faut avouer que l arbiter est un juge.
Par contre, l´arbiter tranche le litige pour lequel il a etait designe, donc il est un juge prive. Ainsi, il ne doit pas respecter certaines obligations imposees aux juges nationaux comme le principe de publicite de l´instance, et cela est le resultat du fait que l´arbitrage est une jurisdiction confidentielle. En conclusion, il faut dire que l´arbiter est un juge, mais un juge prive.
