منازعات الاستثمار الأجنبي والقانون الواجب التطبيق عليها

Abstract

This study deals with foreign investment disputes and the applicable law. Foreign investment is one of the most important aspects of economic activity at present. It is of great importance in the economic and social development of any country as a means through which capital flows and technical expertise. The foreigner through national laws and international conventions, which determine the guarantees of the movement of capital and exploitation, and those guarantees determine the law applicable at the conflict.

Based on these data, the study is aimed at addressing the types of foreign investment disputes, international efforts to settle these disputes, and how to determine the applicable law as an attempt to establish clear bases for this.

يتناول هذا البحث منازعات الاستثمار الأجنبي والقانون الواجب التطبيق عليها, حيث إن الاستثمار الأجنبي يعد من أهم أوجه النشاط الاقتصادي في الوقت الراهن, ويشكل أهمية كبرى في التنمية الاقتصادية والاجتماعية لأي دولة, باعتباره الوسيلة التي يتدفق عبرها رأس المال والخبرة الفنية, لذلك تنظم الدول عمليات الاستثمار الأجنبي من خلال القوانين الوطنية والاتفاقيات الدولية, التي تحدد الضمانات لحركة رؤوس الأموال واستغلالها, ومن تلك الضمانات تحديد القانون الواجب التطبيق عند المنازعة.

واستناداً لهذه المعطيات جاء البحث لتناول أنواع منازعات الاستثمار الأجنبي, و الجهود الدولية لتسوية هذه المنازعات, وكيفية تحديد القانون الواجب التطبيق عليها, كمحاولة لوضع أسس واضحة لذلك.
